Terms of Service

A full Terms of Service document drafted by Nigerian legal counsel is being finalised. In the meantime, these terms represent our current operating principles and commitments. For any legal questions, contact us at medibytechnologies@gmail.com.

1. About MediBY

MediBY is a health technology platform registered in Nigeria that connects patients with licensed doctors and accredited hospitals. MediBY is a technology intermediary — it is not a medical practice and does not employ the doctors or hospitals listed on the platform.

2. Acceptance of terms

By creating an account or using any part of the MediBY platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

3. Eligibility

You must be at least 18 years old to use MediBY without supervision. If you are under 18, you may only use the platform with the explicit consent and supervision of a parent or legal guardian. By using MediBY you confirm you meet this requirement.

4. The AI Doctor

Nature of the AI Doctor

The MediBY AI Doctor provides general health information and triage guidance based on the symptoms you describe. It does not constitute a medical diagnosis, prescription, or professional medical advice. Always consult a licensed medical professional for diagnosis and treatment decisions. In an emergency, call 112 or go to your nearest hospital immediately.

Language support

The AI Doctor supports consultations in English, Nigerian Pidgin, Yorùbá, Igbo, and Hausa. Voice input is supported via Groq Whisper transcription. Accuracy may vary between languages. Do not rely on the AI Doctor as your sole source of medical guidance.

Sharing AI triage summaries with doctors

When you book an appointment through MediBY following an AI Doctor session, the structured triage summary from that specific session — including your reported chief complaint, symptoms, duration, severity, and the AI's recommendations — is shared with the doctor you book with. This is the digital equivalent of a referral note and is done to provide continuity of care. Your doctor cannot access your full conversation history, only the structured summary. If you book an appointment without using the AI Doctor first, no AI data is shared with the doctor. If you book multiple appointments, only the triage session directly linked to each specific booking is shared with that doctor — other sessions remain private.

Audio recording during video consultations (opt-in)

During a video consultation, the doctor may activate an optional audio recording feature to help generate a clinical SOAP note. Both sides of the conversation — doctor and patient — are captured when this feature is active. A visible recording indicator is shown in the call interface when recording is active. The audio is transcribed immediately by Groq's Whisper model and used solely to generate the SOAP note. The raw audio is discarded immediately after transcription and is never stored by MediBY. The resulting SOAP note becomes part of your permanent medical record. You may ask the doctor to stop recording at any time.

4b. Post-consultation medical report

What the report contains

After every completed consultation, MediBY automatically generates a post-consultation medical report in PDF format. This report includes: the attending doctor's name, specialisation, and MDCN registration number; the hospital name and contact details; your name, MediBY ID, and (if you've added them to your profile) your age and sex; the date and type of consultation; the clinical findings (diagnosis, examination notes); the full treatment plan (medications, investigations, follow-up); and the doctor's electronic signature. This report constitutes an official clinical record of your telehealth consultation.

How the report is delivered

The report is emailed to you at your registered email address within minutes of your consultation being marked complete. A download link is also available on your appointment detail page. The download link is valid for 30 days. The report itself is retained in encrypted storage for 7 years in accordance with Nigerian health records law.

Using the report

You may use the post-consultation report at pharmacies, follow-up appointments, or with other healthcare providers. The report is a legitimate clinical document generated from a real MDCN-registered doctor's consultation.

4c. Secure post-appointment messaging

What it is

After a consultation is marked complete, a secure 7-day messaging thread is opened between you and your doctor. You may use this to ask follow-up questions, send additional files (test results, images), or receive clarifications on your treatment plan.

Expiry

The messaging thread closes automatically 7 days after your consultation. After expiry, the thread is read-only and messages are eventually purged from active storage. If you need ongoing care, book a follow-up appointment.

File attachments

You and your doctor may share images (JPEG, PNG, WebP), PDF documents, Word documents, and Excel files up to 10 MB per file. All files are stored securely on private AWS S3 storage and are only accessible via time-limited signed URLs.

Appropriate use

Post-appointment messaging is for follow-up clarification only — not for new consultations, emergency advice, or prescription requests. In an emergency, call 112 or attend your nearest hospital.

4d. Pre-call patient notes

What it is

Before your approved appointment, you may submit a pre-call note — a written description of your current symptoms, concerns, or context — and attach up to 3 files (images of rashes or injuries, PDFs of previous test results, referral letters, etc.) for your doctor to review before the call.

Who sees it

Only the doctor assigned to that specific appointment can view your pre-call note and attachments. Hospital administrative staff cannot see them. They are not shared with any other doctor or healthcare provider.

Optional

Pre-call notes are entirely optional. You are not required to submit one. If you do not submit a note, your consultation proceeds normally.

5. Doctor and hospital relationships

Doctors and hospitals listed on MediBY are independent service providers. They are not employees or agents of MediBY. MediBY verifies their MDCN registration numbers but is not responsible for the quality, accuracy, or outcome of medical consultations provided through the platform. All clinical decisions remain the responsibility of the licensed medical professional.

6. Payments and refunds

Consultation fees

Consultation fees are set by each doctor or hospital, may vary by consultation type (video, in-person, or phone), and are displayed at the time of booking. MediBY charges a platform commission on each transaction, which is deducted automatically from the payment. The amount you see at checkout is the total you pay.

Cancellations — more than 24 hours before appointment

If you cancel your appointment more than 24 hours before the scheduled time, you are entitled to a full refund to your original payment method via Paystack within 3–5 business days.

Cancellations — within 24 hours of appointment

Cancellations made within 24 hours of the scheduled appointment time are not eligible for a refund. This is to protect doctors' time, who have reserved the slot.

If you do not attend (patient no-show)

If you do not attend your appointment, no refund is issued. If you had a genuine emergency, contact us at medibytechnologies@gmail.com within 24 hours — we review emergency appeals on a case-by-case basis.

If your doctor does not attend (doctor no-show)

If a doctor fails to join your video consultation, or does not attend an in-person or phone appointment they confirmed, you can report this directly from your appointment page. A MediBY administrator reviews every report. If we determine the doctor was at fault, you receive a full, automatic refund to your original payment method. If we determine the appointment did in fact take place, no refund is issued and that outcome is recorded on the appointment. Reporting a no-show does not require contacting support by email — it's a dedicated feature on your appointment page, separate from the emergency-appeal process above, which is for your own missed appointments, not your doctor's.

Doctor or hospital cancellations

If a doctor or hospital cancels your confirmed appointment, you are entitled to a full refund regardless of timing.

Rescheduling

You may reschedule an approved appointment once, free of charge, provided the reschedule request is made more than 24 hours before the original appointment time. No additional payment is required — your original payment carries forward.

7. Your account

You are responsible for keeping your login credentials secure. You must not share your account with others or use another person's account. You must provide accurate information when creating your account and keep it up to date. MediBY reserves the right to suspend or terminate accounts that violate these terms.

8. Acceptable use

You agree not to: provide false or misleading health information; impersonate a medical professional; use the platform to harass, abuse, or harm others; attempt to gain unauthorised access to other users' data; use automated tools to scrape or abuse the platform; use the post-appointment messaging feature for emergency medical advice; share another person's medical data without their consent; or use MediBY for any unlawful purpose under Nigerian law.

9. Limitation of liability

To the maximum extent permitted by Nigerian law, MediBY's total liability to you for any claim arising out of your use of the platform is limited to the amount you paid for the specific consultation or service giving rise to the claim. MediBY is not liable for any medical outcomes, missed diagnoses, or consequences of acting on information provided through the platform or by doctors and hospitals on the platform.

10. Intellectual property

All content on MediBY — including the platform design, AI system, text, logos, and software — is the property of MediBY or its licensors and is protected under Nigerian and international intellectual property law. Your post-consultation medical reports and medical records belong to you. You may not reproduce, distribute, or create derivative works of MediBY's platform content without our written permission.

11. Governing law

These Terms of Service are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from your use of MediBY will be resolved in the courts of Nigeria. If a provision of these terms is found to be unenforceable, the remaining provisions continue in full force.

12. Changes to these terms

We may update these Terms of Service from time to time. We will notify you by email at least 30 days before any material changes take effect. Continued use of MediBY after that date constitutes acceptance of the updated terms.
